Wanderin Terms of Service

Wanderin, Inc. ("Wanderin," "we," "us," or "our") provides its services through our website located at www.wanderin.ai and associated technologies (collectively, the "Service"). By accessing or using the Service, you agree to be bound by these Terms of Service ("Terms").

If you do not agree to these Terms, you may not use or access the Service. We may modify these Terms at any time by posting updated versions here. Your continued use of the Service constitutes your acceptance of the revised Terms.

Please read these Terms carefully. THEY CONTAIN AN ARBITRATION AGREEMENT AND CLASS ACTION WAIVER, WHICH AFFECT YOUR LEGAL RIGHTS.

To use the Service, you must be at least 18 years old and capable of entering into binding contracts. If you are under 18, you may not use the Service. You may need to register and provide accurate information to access certain features. You are responsible for maintaining the confidentiality of your account and password and for any activity under your account. We reserve the right to suspend or terminate your account at our discretion.

3.1 Description. Wanderin is an AI-powered travel planning platform designed to help users plan trips, discover destinations, and access curated recommendations. The Service may include the ability to generate personalized itineraries, discover local spots, and book travel services through third-party affiliates.

3.2 AI Assistant. Wanderin's proprietary AI travel assistant helps personalize trip suggestions based on user input and past behavior. Wanderin securely stores user data to improve these services but does not share or sell personal data to third parties. Data is used solely to improve personalized experiences in accordance with our Privacy Policy.

3.3 Google Calendar Integration (Optional). If you choose to connect Google Calendar, Wanderin requests the minimum necessary Google scopes to create and update your trip events. Wanderin will only create, update, or delete **events that were created by Wanderin** and will not read or modify events you or other apps created. You may disconnect at any time at https://myaccount.google.com/permissions or in Wanderin's account settings. Disconnecting stops future sync; events already added to your Google Calendar remain unless you delete them in Google Calendar. See our Privacy Policy for deletion and revocation steps.

4.1 Free & Premium Tiers. Wanderin offers both a free tier (with limited AI personalization) and a premium tier (with full AI features and deeper travel customization). Full pricing details are available at www.wanderin.ai/pricing.

4.2 Payments. Premium plan purchases are processed through Stripe. Users are redirected to Stripe's secure interface. Wanderin does not store credit card information directly.

4.3 Auto-Renewal. Premium subscriptions automatically renew at the end of each billing period (monthly or annually, depending on your selected plan) unless you cancel your subscription before the renewal date. You will be charged the then-current subscription fee at the time of renewal.

4.4 Cancellation. You may cancel your Premium subscription at any time through your Account Settings or by contacting us at info@wanderin.ai. Cancellation takes effect at the end of your current billing period. You will continue to have access to Premium features until the end of the period for which you have already paid. No refunds are provided for partial billing periods, except as required by law or as otherwise specified in promotional terms.

4.5 Refunds. Subscription fees are generally non-refundable. We may provide refunds at our sole discretion or as required by applicable law. If you believe you are entitled to a refund, contact us at info@wanderin.ai with details of your request.

4.6 Price Changes. We reserve the right to modify subscription prices at any time. We will provide at least 30 days' notice of any price increases that affect existing subscribers. Price changes will take effect at your next renewal date.

5.1 Affiliate Partners. Wanderin partners with third-party travel providers via affiliate links. When users click these links, they are directed to the provider's website. Wanderin may earn a commission at no extra cost to you.

5.2 No Liability. Wanderin is not responsible for third-party services. All disputes or cancellations must be resolved with the provider.

We may offer promotions or referral bonuses. Terms will be disclosed with each offer. We reserve the right to terminate or modify any promotion at any time.

You agree not to: - Violate laws or third-party rights. - Distribute malware or disrupt the Service. - Reverse-engineer or replicate our AI. - Use the platform fraudulently or harmfully. - Misrepresent yourself or impersonate others.

All content and technology on the Service is owned by Wanderin or its licensors. You may not reproduce, modify, or distribute our content. We may use anonymized data to improve our services.

By submitting any content (text, photos, suggestions, etc.) to the Service, you grant Wanderin a non-exclusive, royalty-free, perpetual, worldwide license to use, modify, and display such content for service and promotional purposes.

Wanderin respects intellectual property rights. If you believe content on our platform infringes your copyright, contact us at info@wanderin.ai with your name, description of the copyrighted work, and a sworn statement.

Wanderin uses third-party tools and APIs (e.g. Google Maps). Use of such tools is subject to the terms of those providers. We are not responsible for their content or availability.

Our use and transfer of information received from Google APIs will adhere to the Google API Services User Data Policy, including its Limited Use requirements. Wanderin does not use Google user data for advertising and limits operations to the functionality you request.

You are solely responsible for any taxes, fees, or charges imposed by government authorities related to your purchases or use of the Service.

You agree to indemnify and hold harmless Wanderin, its affiliates, officers, agents, and employees from any claim, demand, or damage arising out of your use of the Service.

The Service is provided "as is." Wanderin disclaims all warranties, including merchantability, fitness, or accuracy. We do not guarantee availability or outcomes of travel services.

To the maximum extent allowed by law, Wanderin is not liable for indirect, incidental, or consequential damages. Our total liability will not exceed the greater of $100 or the amount paid to us in the past 6 months.

Any disputes will be resolved by binding arbitration under AAA rules. You waive the right to participate in class actions. Delaware law governs this agreement. Venue is in Delaware unless otherwise agreed.

We reserve the right to suspend or terminate your account for any reason, including misuse of the Service or violation of these Terms.

If accessed by a U.S. government entity, the Service is provided with RESTRICTED RIGHTS. Use, duplication, or disclosure is subject to applicable federal laws.

21.1 Usage Expectations. Wanderin's Premium Plan includes generous usage limits designed to support frequent travel planning. To ensure fair and sustainable access for all users, a soft cap of 1,000 AI-generated messages per month is applied.

21.2 Monitoring and Enforcement. Wanderin reserves the right to monitor usage patterns to detect excessive activity. If we determine that your usage substantially exceeds the intended scope, we may notify you, throttle response times, limit further access, or offer an upgrade path to a higher usage tier.

21.3 No Abuse. Automated, programmatic, or high-frequency use of the Premium Plan in a way that mimics or replaces enterprise licensing is strictly prohibited. Any abuse of the system may result in immediate suspension or termination of your account without refund.

21.4 Data Export and Deletion Rights. Enforcement of this Fair Use Policy, including account suspension or termination, will never impact your ability to export your data or request deletion of your account and data. Even if your account is suspended or terminated for violation of these Terms, you retain the right to request access to, export, or delete your personal data in accordance with our Privacy Policy and applicable law.

21.5 Contact. If you believe your usage needs exceed the default limits, contact support at info@wanderin.ai to discuss a custom solution or enterprise options.

22.1 Right to Modify. Wanderin reserves the right to modify, suspend, or discontinue any aspect of the Service at any time, including features, integrations, or functionality.

22.2 Notice of Material Changes. If we plan to deprecate or significantly change features that affect synced Google Calendar events or other material functionality, we will provide notice through: - In-app notifications or banners - Email notifications to affected users (to the email address associated with your account) - Updates to our website or Service documentation

We will provide at least 30 days' notice for material changes that affect active calendar syncs or substantially alter core functionality, except where changes are required for security, legal compliance, or other urgent reasons.

22.3 No Liability for Changes. We are not liable for any inconvenience, loss, or damage resulting from changes, deprecations, or discontinuations of Service features. You are responsible for exporting or backing up your data if you wish to preserve it before any deprecation takes effect.
